What Is a Binding Concept Development Plan for City Land Development?

A Binding Concept Development Plan (BCDP) is a formal, regulatory framework established to guide the responsible development of land within a county.

In this context, the plan sets out a clear vision for how specific areas of a county will be transformed, ensuring that all stakeholders—including county officials, developers, and the public—are committed to following agreed-upon objectives, design guidelines, and timelines.

Once adopted, the BCDP becomes a binding document, meaning its standards and requirements must be upheld in subsequent planning, permitting, and construction processes.

Such a plan can include details about land use zoning, building heights, density, public spaces, infrastructure requirements, environmental protections, and transportation links.

By providing these explicit guidelines, the BCDP helps maintain the integrity of a county’s growth while balancing economic, social, and environmental interests.

What Are the Benefits of a Binding Concept Development Plan?

Case Study: Limitations of the Current Approach in the City of Venice

The City of Venice does not currently implement Binding Concept Development Plans. Instead, zoning decisions are made by the city council following reviews by city staff and the City Planning Commission, based on proposals submitted by developers.

Once zoning approval is granted, developers may alter project plans during the site and development phase as long as changes remain consistent with zoning standards. This flexibility has led to uncertainty and unintended outcomes.

A notable example is an ongoing lawsuit in which the city is attempting to halt a development that—while legally zoned—was not anticipated or supported by either the city council or the surrounding community.

Because zoning approval had already been granted, the city’s ability to intervene is limited, and court rulings thus far have not favored the city. Had a Binding Concept Development Plan been in place, this situation may have been avoided.

As it stands, taxpayer funds are being spent on legal action over a development that technically complies with zoning but does not align with community expectations.

What Can Citizens Do?

  • Ask City Council to have staff review the Binding Concept Development Plan and report findings back to council.
  • Ask City Council to vote to approve adoption of a Binding Concept Development Plan.
